This LiVideo Privacy Policy (this “Privacy Policy”) describes how and when LiVideo, LLC (“LiVideo”, “we”, “us”, or “our”) collects, uses, maintains, and shares information when you use the LiVideo app, our affiliated network of websites (including any versions optimized for viewing on wireless or mobile devices), SMS, APIs, email notifications, all versions of mobile applications published by LiVideo; all text, graphics, photographs, images, sounds, audiovisual moving images and/or video, and illustrations on the LiVideo app; and all other interactive features, services, and communications provided by LiVideo apps (collectively, the “Services”). LiVideo receives your information through the Services. LiVideo also receives information from our partners and other third parties. When using any of our Services, you consent to the collection, use, and disclosure of your Personal Information as described in this Privacy Policy. Any terms not defined herein shall have the meaning given to such term in the LiVideo Terms and Conditions.

INFORMATION COLLECTION AND USE LiVideo collects and uses information we receive to provide, measure, and improve our Services over time. We may also share or disclose your information, including Personal Information, for purposes required or authorized by or under applicable law.

Basic Account and Contact Information. You must register to create an account in order to broadcast and consume most Content. When you choose to create or update an account, you must provide access credentials (such as your username and password), Personal Information (including your name, address, e-mail address, profile picture, and phone number), and other information. Please note that if you do not provide us with such information, then we may not be able to register you, in which case you may not have full access to the Services offered by LiVideo. If you register as a Broadcaster, you must authenticate your ability to meet the minimum qualification to broadcast by using another service such as Twitter, Facebook, Instagram, or Vine. On the Services, your profile picture and username are listed publicly. Any use of the Services including searching and viewing profile pages will require registration. If you are viewing the content as a guest, please note that LiVideo may still be able to collect certain information about you, like your time zone, device location and language as described in this Privacy Policy.

LiVideo may use your information, including Personal Information, such as your e-mail address or phone number, to send you information about the Services if you consented to receiving our email marketing communications, respond to your requests, customize your account, or facilitate and enable your use of the Services, and for other purposes as set out in this Privacy Policy. Broadcasters may use your information, including Personal Information, to send you information about upcoming broadcasts, offers and contests and other information directly from the Broadcaster. By providing LiVideo with your phone number, you agree to receive text messages to that number from LiVideo and the Broadcaster. We may also use your contact information to market to you and help others find your account, including through third-party services and client applications. You can let us know at any time if you want to opt out from having your information used by us to market to you, by contacting us using the contact details at the end of this Privacy Policy or opting out when we offer you the opportunity to do so. Your consent will be deemed if you do not opt out when we offer you the opportunity to do so, and will remain current until you advise us otherwise.

Customer Service. If you contact us, we may keep your message, e-mail address, and contact information to respond to your customer service request. We routinely destroy Personal Information that is no longer required for the purposes described herein, in accordance with applicable laws.

Content, Following and other Public Information.

Broadcasters. Your Submitted Content will be available to other Users of the Services. The data provided with your Submitted Content will include where and when you broadcast and the application you used to broadcast.

Users. Your Personal Information will be shared with the Broadcasters to whom you subscribe. Broadcasters will also receive information about when you watch Broadcasters’ Content and information regarding how you consumed Content including the language, country, and time zone associated with your account, people to whom you subscribe, your comments on the Broadcaster Content, the Content you mark as favorites or share, the frequency and duration of your activities, and other information that result from your use of the Services. Your user name and profile information will be visible to other Users when you interact on our chat feature or otherwise use the Service. When you subscribe to a Broadcaster, share information or comment via the Services, you should think carefully about what you are making public.

We may use your Submitted Content or Content that you view and related information to make inferences, such as topics of interest, and to customize the Content we show you. Our default is to make your Submitted Content and information you provide through the Services available to Broadcasters and subscribers for as long as you do not delete it. The Services broadly and instantly disseminate your Submitted Content and profile information to a wide range of Broadcasters, Users and services, and we may not or cannot limit or control their behavior.

Location Information. LiVideo may receive information about your location. We may also infer or determine your location by using other data from your device, such as precise location information from GPS, information about wireless networks or cell towers near your mobile device, or your IP address. If you have turned on location services for our Services, the location of your Submitted Content may be shown. We may use and store information about your location to provide features of our Services, and to improve and customize the Services, for example, by identifying more relevant content such as suggestions for popular Broadcasters to follow who have been tagged or who are broadcasting near your location.

Links. LiVideo may keep track of how you interact with links across our Services, including our e-mail notifications, third-party services, and client applications. We do this to improve our Services, provide more relevant Content, and be able to share aggregate click statistics such as how many times a particular link was clicked.

Cookies and Other Automated Data Collection. LiVideo may use cookies and other technologies to collect additional usage data and to improve our Services. A cookie is a small data file that is transferred to your mobile device. LiVideo may use both session cookies and persistent cookies to better understand how you interact with our Services, to monitor aggregate usage by our Users and web traffic routing on our Services, and to customize and improve our Services. Most Internet browsers automatically accept cookies. You can instruct your browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. However, some of our Services may not function properly if you disable cookies.

Log Data. When you use our Services, we may receive information such as your IP address, browser type, operating system, the referring web page, URL visited, location, your mobile carrier, device information (including device and application IDs), search terms, and cookie information (“Log Data”). We receive Log Data when you interact with our Services, for example, when you access our applications, sign into our Services, view videos hosted by LiVideo, interact with our e-mail notifications. We may also receive Log Data when you click on, view, or interact with links on our Services, including links to third-party applications, such as when you choose to install another application through the Services. We use Log Data to measure, understand, and improve our Services, to make inferences such as potential topics of interest, and to customize the content we show you.

Third Parties and Affiliates. LiVideo uses third-party service providers to help us understand and improve the use of our Services. These third-party service providers may use cookies and other technologies to collect information sent by your browser as part of a web page request and information about your use of our Services. Third-party service providers may share information with us, like a browser cookie ID, IP address, website URL visited, mobile device ID, or cryptographic hash of a common account identifier (such as an email address). We may also receive and share information about you from or with our corporate affiliates and with our vendors and suppliers, in order to help provide, understand, and improve our Services and our affiliates’ services.

Affiliate and Third-Party Content. The Services may feature links to the services of LiVideo’s partners, suppliers, sponsors, and other third parties which may or may not be affiliated with LiVideo. We do not control the content or links that appear on these sites and are not responsible for the content or practices of sites and services linked from LiVideo’s Services. Third party sites and services, including their content, links, terms of service, and privacy policies, may change. All such third party sites and services are subject to their own respective terms and conditions, unrelated to LiVideo’s Terms of Service, this Privacy Policy and relevant policies.


LiVideo uses and shares your information, including Personal Information, in the following circumstances:

When You Subscribe to a Broadcaster: We share your information, including Personal Information, with Broadcasters when you subscribe to receive Broadcaster Content. This information includes your username, your email address, phone number and other information about you from your profile, including your location. We cannot control how the Broadcaster will use this information, and when you subscribe to a Broadcaster, you are consenting to LiVideo sharing your Personal Information with the Broadcaster.

Using the Services: We may share or disclose your information, including Personal Information, at your direction, such as when you update your profile information, or subscribe to a Broadcaster.

Vendors and Service Providers. We engage vendors to perform functions and provide services to us in the United States and abroad. We may share your information, including your Personal Information, with such service providers subject to obligations consistent with this Privacy Policy, the agreements we enter into with them, and any other appropriate confidentiality and security measures.

Legal Requests and Harm. Notwithstanding anything to the contrary in this Privacy Policy, we may access, use, preserve, and disclose your information, including your Personal Information, if we believe in good faith that it is reasonably necessary to:

comply with a law, regulation, legal process, or governmental request;

protect the safety of any person including to prevent death or imminent bodily harm;

detect, prevent, and address fraud, security, or technical issues; or

protect LiVideo’s rights or property.

We may also retain information from disabled accounts as appropriate to meet legal requirements. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections you may have to a third party’s request to disclose your information.

Business Transfers and Affiliates. In the event LiVideo is involved in a bankruptcy, merger, acquisition, reorganization, or sale of assets, your information, including your Personal Information, may be sold or transferred as part of that transaction. This Privacy Policy will apply to your information as transferred to the new entity, which such new entity may use your Personal Information for the same purposes as set out in this Privacy Policy, including, but not limited to, for direct marketing purposes. If Personal Information is disclosed prior to the completion of such transaction, it will be disclosed pursuant to an agreement that requires the receiving organization to only use and disclose information for purposes related to the transaction and to use appropriate security safeguards to protect the Personal Information. If the transaction does not proceed, the receiving organization will be required to return or destroy the Personal Information within a reasonable timeframe. We may also disclose information about you to our corporate affiliates in order to help provide, understand, and improve our Services and our affiliates’ services.

Aggregated and Anonymized Information. “Anonymized Data”  is data derived from Personal Information that you or other Users have provided to LiVideo but containing no personal identifier. LiVideo maintains sole ownership to the aggregation of any Anonymized Data and may use Anonymized Data at the sole discretion of LiVideo, including transferring, conveying, selling, manipulating and otherwise using such Anonymized Data. We may share or disclose aggregate and Anonymized Data about you with any party for any reason. We do not consider aggregated and Anonymized Data to be Personal Information.

Other Purposes. LiVideo may also share or disclose your information, including Personal Information, for purposes required or authorized by or under applicable law.


Modifying Your Information. We take reasonable steps to ensure that any Personal Information in our custody is accurate and up-to-date for the purposes for which the Personal Information is to be used by us. In most instances, we rely on Users to notify us of any changes to their Personal Information. To this end, if you are a registered User, we provide you with tools and account settings to access, correct, delete, or modify some of the Personal Information, such as name and password, that you provide to us and which is associated with your account. Upon written request to you will be informed of the existence, use and disclosure of your Personal Information, and will be given access to that Personal Information.


Destruction of Personal Information. We routinely destroy Personal Information that is no longer required for the purposes described herein, in accordance with applicable laws.


Our Services are based in the United States. If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your Personal Information to the United States and processing globally. By providing your Personal Information, you consent to any transfer and processing in accordance with this Privacy Policy.


We take steps to ensure that your information, including your Personal Information, is treated securely and in accordance with this Privacy Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure of any information. Additionally, only staff and service providers who have a legitimate business purpose for accessing the Personal Information collected by us are authorized to do so. Unauthorized use of Personal Information by anyone affiliated with us is prohibited and is grounds for dismissal.

Electronic Communications. By using the Services or providing information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Services. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Services or sending an e-mail. Our Services are not directed to persons under thirteen (13), or the equivalent minimum age in the relevant jurisdiction, without parental consent. We do not knowingly collect Personal Information from children under thirteen (13) or the equivalent minimum age in the relevant jurisdiction. If we become aware that a child under thirteen (13) or the equivalent minimum age in the relevant jurisdiction has provided us with Personal Information, we will take steps to remove such Personal Information and terminate the child’s account. We may revise this Privacy Policy from time to time. Changes to this Privacy Policy are effective as soon as they are posted to the Services. If we make a change to this Privacy Policy that is materially less restrictive on our use of your Personal Information, we will attempt to notify you through the Services such as via a broadcast notification or e-mail to the e-mail address associated with your account in accordance with applicable law.
